Terms and conditions - garden services
 
  1. Contractor will furnish labour and equipment necessary to perform the above services. Contractor aims to provide as much as possible of garden maintenance services mentioned above within the agreed time of working hours(weather dependant). Should Contractor fall behind due to adverse weather conditions, we will inform clients of delays or rearrange the visit asap. The Client may ask us to rearrange our agreed visit date by email or phone minimum 48 hours before the arranged visit.

  2. Contractor guarantees that it will perform its service in a workmanlike manner, employ only professionally-qualified gardeners to do the work, or employees working under the supervision and control of such gardeners; and not, without the Client’s prior consent, fell, cut or lop any timber trees, or remove any shrubs, bushes or hedges now on the Gardens except if decayed, dead or dangerous, and must not alter the design, style or layout of the Gardens, grass over existing beds or create new beds. Customer agrees to promptly notify contractor in writing of any dissatisfaction with the maintenance service to insure that maintenance is performed as agreed.

  3. Eye Art Garden Ltd will send an invoice to the Client after each visit or end of month if there are multiple visits per month. Payment terms are 14 days from date of invoice and we understand and will exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms.

  4. You have a right to cancel this contract without giving any reason (in writing or by email only) any time up until the cancellation period expires.  The cancellation period lasts for 14 days starting on the day after the contract was agreed. If the Customer cancels this Contract outside the fourteen days he agrees to pay any losses and costs the Contractor suffers because of the cancellation. If the EAG cancels the Contract he must pay the Customer any losses or costs suffered because of the cancellation. One month notice can be given under this Agreement which shall be in writing and shall be sent by first class recorded mail or by e-mail to the address of the relevant Party set out in clause 1.

  5. The client is responsible for ensuring that grassed areas to be maintained are kept free of dog mess, moles and other items that may cause damage to/harm machinery, operatives or third parties. It is the client’s responsibility to ensure that the area to be maintained is safe, and to point out in writing any known hazards such as underground and overhead services, drains, pods, ditches or water courses. The customer shall provide water and electricity for Contractor at no charge to enable Contractor to carry out agreed works. The client shall provide access to the site during the agreed  working hours and a storage place for materials during the progress of the works. The Client must provide necessary parking permits, parking space or parking tickets for the vehicles of the Contractor for the duration of the contract. If the Contractor receives any parking tickets, due to failure of the Client to supply such permits, the Client will reimburse the Contractor for these charges.

  6. Following the planting of new plants / placing of new items the Client shall comply with all reasonable instructions given by the Contractor and /or the manufacturer for the care of such plants / items.  In relation to plants, the Client shall water and feed them at the times and by the means specified by the Contractor. Save where the same forms part of the Services, the Client shall be responsible for the care of all plants / items at all times after they have been planted / placed by the Contractor.  The Contractor shall have no liability to the Client for any plant which dies or fails to flourish as a result of any act or omission of the Client or any inclement weather conditions, other unfavourable environmental condition or matter outside of the reasonable control of the Contractor.

  7. Customer will be charged for all materials, plants used and waste removal separately.

  8. Should any variations be required to the contract by either Contractor or the Client, 14 working days notice must be given in writing. Any complaint that the Client has arising from the Contract works must be reported to the Contractor in writing within reasonable time of discovery of the problem. The Contractor will properly investigate any complaint received and if the Contractor’s work is deemed to be faulty then the Contractor is liable to conduct extra work as deemed sufficient to remedy the fault at no charge to the Client.

  9. Contractor will be responsible where required to provide barriers, signage or other measures in order to protect members of the public and the Client.

  10. The Client shall not materially alter any part of the Gardens from the way they were when visited by the Contractor or described by the Client to the Contractor. The Client acknowledges and agrees that if any such alteration is made, then the amount and scope of the Services and/or the Fees may need to be changed if, in the reasonable opinion of the Contractor, the Services need to be increased. Furthermore, the Client shall not remove or change the type of soil in the areas where the Gardening Services are to be provided.

  11. All original designs, drawings, specifications, photographs and written material remain the property of the contractor. The Contractor reserves the right to use any such material for promotional purposes or for any other purpose, unless the Client has purchased the copyright. Any specifications, quotes or estimates are confidential and are subject to commercial confidentiality.

  12. EAG will operate in compliance with health, safety and environmental legislation throughout the contract.

  13. Eye Art Garden Ltd shall insure all persons employed or engaged in the provision of the Services against accident. The Contractor shall at all times maintain with reputable insurers such insurances as may be necessary to cover all liability which the Contractor may incur in respect of any personal injury, death or damage to property whatsoever caused by or arising out of or in the course of the carrying out of the Contractor’ duties under this Agreement, such insurance to be for at least £1,000,000.  The Contractor shall following a request from the Client supply a copy or evidence of such insurance and of the receipt for the current premium.

  14. Eye Art Garden Ltd is registered as lower tier waste carriers. Our registration number is CBDL57990. The term waste removal refers only to waste produced by Eye Art Garden Ltd. Where possible we encourage customers to have compost areas and/or green bins.

  15. The validity, construction and performance of this Agreement shall be governed by English law and shall be subject to the non-exclusive jurisdiction of the English courts to which the Parties submit.

  16. It is important that the Client reads and understands the Terms and Conditions that will apply to the Contract before signing.
